5. Shipping and Delivery

We offer shipping to addresses within the United States. International shipping may be available for select countries. Shipping costs and delivery times vary based on your location and the shipping method selected.

5.2 Delivery Times

Estimated delivery times are provided for your convenience and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, weather conditions, or other factors beyond our control.

5.3 Risk of Loss

All purchases of products from the Site are made pursuant to a shipment contract. The risk of loss and title for such products pass to you upon our delivery to the carrier.

6. Return and Refund Policy

6.1 60-Day Money-Back Guarantee

We offer a 60-day money-back guarantee on all NeuroXen products. If you are not completely satisfied with your purchase, you may return the product within 60 days of the original purchase date for a full refund of the purchase price (excluding shipping and handling fees).

6.2 Return Conditions

To be eligible for a return:

• The return must be initiated within 60 days of the purchase date
• Products must be returned in their original packaging
• You must contact our customer service team to obtain a Return Merchandise Authorization (RMA) number
• Returns without an RMA number will not be accepted

6.3 Refund Processing

Once we receive your return, we will inspect the products and process your refund within 5-7 business days. Refunds will be issued to the original payment method used for the purchase. Please allow 5-10 business days for the refund to appear in your account.

7. User Accounts

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of:

• Breach of these Terms
• Any breach of your representations and warranties set forth in these Terms
• Your violation of the rights of a third party, including but not limited to intellectual property rights
• Any harmful act toward any other user of the Site with whom you connected via the Site

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and defined following the laws of the State of California, United States. NeuroXen LLC and yourself irrevocably consent that the courts of California shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms.

14.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, the parties agree to first attempt to resolve the dispute through good-faith negotiations.

14.3 Arbitration

If negotiations fail, any dispute shall be determined by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.

15. Modifications to Terms

We reserve the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.

16. Termination

These Terms shall remain in full force and effect while you use the Site. If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.

17. Severability and Waiver

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

18. Entire Agreement

These Terms, our Privacy Policy, and any other legal notices published by us on the Site shall constitute the entire agreement between you and us concerning the Site. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
